Introduction

Welcome to jegs.com (the “Site”), operated by JEGS High Performance (“JEGS,” “we,” “our,” or “us”). JEGS provides aftermarket automotive parts, accessories, and related products and services (collectively, the “JEGS Services”). These Terms of Use (this “Agreement”) govern your access to and use of the Site and the JEGS Services. Please also review our Privacy Policy, which is incorporated into this Agreement by reference.

By accessing or using the Site or the JEGS Services, you agree to be bound by this Agreement. If you do not agree, please do not use the Site or the JEGS Services.

PLEASE NOTE: THIS AGREEMENT CONTAINS IMPORTANT PROVISIONS REGARDING YOUR ACCOUNT, PURCHASES, AGE REQUIREMENTS, CONTENT YOU SUBMIT, TEXT MESSAGING, DISCLAIMERS, LIMITATIONS OF LIABILITY, AND DISPUTE RESOLUTION. PLEASE READ IT CAREFULLY.

1. Your JEGS Account, Payment, and Eligibility

You may need your own JEGS account to use certain JEGS Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. Visit Your Payments to manage your payment options.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.

JEGS does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the JEGS Services only with the involvement of a parent or guardian. Parents and guardians may create profiles for teenagers in their JEGS Household.

Alcohol listings on JEGS are intended for adults. You must be at least 21 years of age to purchase alcohol, or to use any site functionality related to alcohol.

JEGS reserves the right to refuse service, terminate accounts, terminate your rights to use JEGS Services, remove or edit content, or cancel orders in its sole discretion.

2. Use of the Site and JEGS Services

You agree to use the Site and the JEGS Services only for lawful purposes and in accordance with this Agreement. You agree that you will not:

(a) Use the Site or JEGS Services in violation of any applicable law or regulation;

(b) Attempt to gain unauthorized access to the Site, other users’ accounts, or any systems or networks connected to the Site;

(c) Interfere with or disrupt the operation, security, or integrity of the Site or JEGS Services;

(d) Use any automated means (such as bots, scrapers, or crawlers) to access the Site or collect data, except as permitted for standard search-engine indexing;

(e) Introduce any viruses, malware, or other harmful code; or

(f) Resell, reproduce, or exploit any portion of the Site or JEGS Services without our express written consent.

3. Reviews, Comments, and Other Content You Submit

You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. JEGS reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant JEGS a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant JEGS and its sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this Agreement and will not cause injury to any person or entity; and that you will indemnify JEGS for all claims resulting from content you supply. JEGS has the right but not the obligation to monitor and edit or remove any activity or content. JEGS takes no responsibility and assumes no liability for any content posted by you or any third party. 

4. Products, Listings, Pricing, and Orders

JEGS strives to provide accurate product descriptions, pricing, and availability; however, we do not warrant that product descriptions, pricing, or other Site content are accurate, complete, reliable, current, or error-free. In the event of a pricing or description error, JEGS reserves the right to correct the error, and to refuse or cancel any order placed based on incorrect information, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and your order is canceled, JEGS will issue a refund in the amount of the charge.

All orders are subject to acceptance by JEGS, and JEGS may, in its sole discretion, limit or cancel quantities purchased per person, per household, or per order.

Risk of Loss

All purchases of physical items from JEGS are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the items to the carrier. Once the items are tendered to the carrier, you bear the risk of any loss or damage that may occur during transit, except to the extent otherwise required by applicable law or provided under any shipping protection or insurance option you select at checkout.

Returns, Refunds, and Title

JEGS does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return; in that situation, JEGS does not take title to the refunded item. All returns and refunds are subject to our Returns Policy, including any applicable eligibility requirements, time limits, restocking fees, and condition standards. Product Descriptions

JEGS attempts to be as accurate as possible in describing its products. However, JEGS does not warrant that product descriptions, fitment information, specifications, pricing, images, or other content of any JEGS Service are accurate, complete, reliable, current, or error-free. If a product offered directly by JEGS is not as described, your sole remedy is to return it in unused, unopened, and resalable condition in accordance with our Returns Policy. 

5. Fitment, Installation, and Vehicle Safety Disclaimer

Aftermarket automotive parts may require professional installation and may affect vehicle performance, emissions compliance, warranty coverage, and safety. It is your responsibility to confirm the fitment, legality, and appropriateness of any part for your specific vehicle and intended use, including compliance with applicable federal, state, and local laws (such as emissions and street-legality requirements). Certain products may be intended for off-road, racing, or competition use only and may not be legal for use on public roads. JEGS is not responsible for improper installation, misuse, or use of products in a manner inconsistent with manufacturer instructions or applicable law.

6. Mobile Text Messaging Service (SMS) Terms and Conditions 

These Mobile Terms and Conditions govern your enrollment in and use of the JEGS text messaging program (the “Service”). The Service is offered as a convenience and is subject to these terms. 

6.1 Enrollment and Eligibility

Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. You may not enroll if you are under 18 years old. Before the Service will start, you will need to agree to these Terms. JEGS HIGH PERFORMANCE RESERVES THE RIGHT TO STOP OFFERING THE SERVICE AT ANY TIME WITH OR WITHOUT NOTICE.

7. Intellectual Property

The Site and its content–including text, graphics, logos, images, product descriptions, software, and the overall design and “look and feel” (collectively, the “Content”)–are owned by or licensed to JEGS and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Subject to your compliance with this Agreement, JEGS grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from the Content without our prior written consent.

“JEGS,” the JEGS logo, and related marks are trademarks or service marks of JEGS. Other trademarks appearing on the Site are the property of their respective owners.

8. Third-Party Links

The Site may contain links to third-party websites or resources that are not owned or controlled by JEGS. We are not responsible for the content, products, services, or privacy practices of third-party sites. Accessing them is at your own risk and subject to their own terms and policies.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, THE JEGS SERVICES, AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. JEGS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT. Nothing in this section affects any manufacturer’s warranty that may accompany a product, or any warranty rights that cannot be excluded under applicable law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES–INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL–ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, THE JEGS SERVICES, THE TEXT MESSAGING SERVICE, OR ANY PRODUCTS PURCHASED, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF JEGS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless JEGS and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of this Agreement; (b) your misuse of the Site or JEGS Services; (c) your violation of any law or the rights of any third party; or (d) any content or material you submit.

12. Termination

JEGS reserves the right to refuse service, terminate accounts, terminate your rights to use the JEGS Services, remove or edit content, or cancel orders in its sole discretion, at any time and without notice. Provisions that by their nature should survive termination (including intellectual property, content licenses, disclaimers, limitations of liability, indemnification, and governing law) shall survive.

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Subject to any applicable arbitration provision, you agree that any dispute arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in Franklin, Ohio, and you consent to the personal jurisdiction and venue of such courts.

14. Changes to This Agreement

JEGS may revise this Agreement at any time. Updates will be posted on the Site with a revised “Last Updated” date. Your continued use of the Site or JEGS Services after changes are posted constitutes acceptance of the revised Agreement.

15. Severability and Waiver

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect. JEGS’s failure to enforce any provision does not waive its right to do so later.
